1. Acceptance of Terms & Eligibility
By accessing or using the US African Food Market website, mobile application, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use immediately. You must be at least 18 years old or the age of majority in your jurisdiction to create an account or place orders. By using the Service, you represent and warrant that you meet this eligibility requirement.
2. Account Registration & Security
To place orders, you must create an account with accurate, current, and complete information. You may register using your email address and password, or through third-party authentication providers such as Google or Apple. When you authenticate through a third-party provider, you authorize us to access certain account information from that provider as permitted by your settings with them.
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access or use of your account. We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised or are being used in violation of these Terms.
3. Orders, Pricing & Payment
All prices are listed in US dollars and include applicable product pricing but may not include service fees, delivery fees, or applicable taxes, which are calculated at checkout. Prices are subject to change without notice. We reserve the right to correct pricing errors and to refuse or cancel any order at our sole discretion, including orders affected by pricing errors, regardless of whether the order has been confirmed.
Orders are subject to product availability. If an item in your order is unavailable, we may substitute it with a comparable item or issue a refund for the unavailable item. A service fee applies to all orders. Delivery fees may apply based on your order total and delivery distance.
Payment is due at the time of checkout. We accept major credit cards, debit cards, and other payment methods displayed at checkout. By submitting payment, you represent that you are authorized to use the payment method provided.
4. Delivery
Delivery times are estimates only and are not guaranteed. Actual delivery times may vary based on demand, weather, traffic, and other factors beyond our control. We deliver within our designated service area in the Rock Island, IL metro area. A minimum order amount of $25.00 is required for delivery. Free delivery is available on orders over $75.00.
You are responsible for providing accurate delivery instructions and ensuring someone is available to receive perishable items. We are not liable for spoilage or damage that occurs after delivery to the specified address. If delivery cannot be completed due to incorrect address, lack of access, or inability to reach the recipient, we may charge a redelivery fee or cancel the order.
5. Returns, Refunds & Disputes
If you receive damaged, spoiled, incorrect, or materially misrepresented items, contact us within 24 hours of delivery for a full refund or replacement at our discretion. You may be required to provide photographic evidence of the issue. Due to the perishable nature of food products, we cannot accept returns on items that have been opened, consumed, or improperly stored after delivery.
Refunds will be issued to the original payment method within 5–10 business days. We reserve the right to limit or deny refund requests that we reasonably determine to be fraudulent or abusive.
6. Gift Cards & Promotional Credits
USAFM gift cards and promotional credits are redeemable only for purchases on our platform. Gift cards have no expiration date and carry no fees. Gift cards cannot be redeemed for cash except where required by law. Lost or stolen gift cards cannot be replaced without proof of purchase. Gift card balances are applied automatically at checkout. Promotional credits may be subject to additional terms, including expiration dates and minimum order requirements, which will be disclosed at the time of issuance.
7. Intellectual Property
All content on the Service — including but not limited to text, graphics, logos, product images, page layouts, software, and compilation of content — is the property of US African Food Market or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws. The USAFM name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of US African Food Market. You may not use them without our prior written permission.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. This license does not include the right to reproduce, distribute, modify, publicly display, or create derivative works from any content on the Service.
8. User Content & Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service, other accounts, or computer systems
- Interfere with, disrupt, or attempt to compromise the security or integrity of the Service
- Submit false, misleading, or fraudulent information, including fraudulent orders or payment information
- Resell products purchased through the Service for commercial purposes without our written consent
- Use automated systems, bots, scrapers, or similar technology to access the Service
- Post or transmit any content that is defamatory, obscene, threatening, or that infringes on any third-party rights
- Circumvent, disable, or interfere with security-related features of the Service
We reserve the right to remove any content and to suspend or terminate your account for any violation of these Terms, at our sole discretion and without prior notice.
9. Third-Party Services & Links
The Service may contain links to third-party websites or integrate with third-party services (including Google and Apple for authentication, and payment processors for transactions). We do not control and are not responsible for the content, privacy policies, or practices of any third-party services. Your use of third-party services is governed by their respective terms and policies. We encourage you to review the terms and privacy policies of any third-party service before using it.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.
Product descriptions, images, nutritional information, and allergen information are provided for informational purposes only and may not be completely accurate. You should always read product labels before consumption, particularly if you have food allergies or dietary restrictions.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL US AFRICAN FOOD MARKET, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, WHETHER ARISING FROM CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Our total aggregate liability for any claim arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the event giving rise to the claim or (b) one hundred US dollars ($100.00). Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless US African Food Market, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any content you submit or transmit through the Service.
13. Dispute Resolution & Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may initiate binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in Rock Island County, Illinois, unless both parties agree otherwise.
YOU AND USAFM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal action or proceeding not subject to arbitration shall be brought exclusively in the state or federal courts located in Rock Island County, Illinois, and you consent to the personal jurisdiction of such courts.
15. Severability & Waiver
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
16. Entire Agreement
These Terms, together with the Privacy Policy and Health Data Notice, constitute the entire agreement between you and US African Food Market regarding your use of the Service and supersede all prior agreements, representations, and understandings. Any amendments to these Terms must be made in writing and posted on the Service.
17. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, for significant changes, by email or a prominent notice on the Service. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account.
